Wrongful Termination

Wrongful termination refers to the involuntary termination of an employee in violation of the law or an employment contract. For example, federal and some state laws enumerate specific protected classes against which employers must not discriminate.

Under federal and West Virginia law, employers must not discriminate against employees based on certain protected classes. It is illegal to make employment decisions based on:

  • Race;
  • Gender;
  • Disability;
  • Age;
  • Religion; or
  • National Origin;

In addition, West Virginia provides protections for those individuals who are off of work on Workers’ Compensation. If you have been wrongfully terminated, you have rights.
